Responsibilities

Orrick is seeking talented and motivated associates with 2 to 5 years of experience in copyright, trademark, trade secret and/or false advertising law to join our intellectual property/technology litigation practice. . Orrick is at the forefront of some of the most watched cases in the country, including defending Microsoft and others in the wave of first-of-their-kind lawsuits challenging the legality of training generative AI models. And our teams work with the biggest brands and most cutting-edge technology companies in the world.

We are true trial lawyers and try numerous cases a year. Orrick is one of the few firms with a nationwide team of renowned first-chair trial lawyers specializing in copyright, trademark, false advertising trade-secret, in addition to having some of the deepest expertise in AI litigation. We are one of the few national IP groups that actively litigates and has expertise in data-collection disputes under the CFAA. We practice in multiple forums, including federal court, state court, the Trademark Trial and Appeal Board, the ITC, and arbitral proceedings including the UDRP process. And, we apply our expertise gained through litigating and winning cases to counsel our clients on enforcement strategies and risk.

Our U.S. Intellectual Property team is primarily based in our Southern California, Bay Area, and East Coast offices.

Key Responsibilities:

  • Manage intellectual property/technology litigation and enforcement matters in the copyright, trademark, trade secret, false advertising and AI spaces.
  • Collaborate with cross-functional teams to deliver comprehensive legal solutions to clients.
  • Develop strategy for complex litigation and enforcement actions.
  • Counsel clients on legal risks related to product development.
  • Conduct legal research and analysis and demonstrate strong legal writing skills.
  • Manage the discovery phase of litigation, including working with the client and vendors to run e-discovery.
  • Exhibit excellent verbal communication skills.
  • Demonstrate strong client-facing skills and work effectively as a team player.

Qualifications

  • 2 to 5 years of experience in trademark, copyright, false advertising, and/or trade-secret law including litigation.
  • Strong understanding of one or more of the Lanham Act, the Copyright Act, the DMCA, federal and state trade-secret statutes, and computer-access laws such as the CFAA and related state laws.
  • Trial experience is preferred.
  • Willingness to engage with a broad range of laws and legal principles necessary to support technology clients with legal disputes.
  • Highly motivated with excellent academic credentials and superior writing and communication skills.
  • Membership in the State Bar of the office location is required.

Compensation and Benefits

The expected salary range for this position is between $235,000 and $365,000.

Orrick is committed to providing a comprehensive, competitive, and thoughtful total compensation package to our attorneys and staff, wherever they work. This compensation and benefits information is based on the Orrick's estimate as of the date of publication and may be modified in the future. The level of pay within the range will depend on a variety of job-related factors that may include, but not limited to, qualifications, relevant experience or education, particular skills or expertise, geography. Other compensation may include an annual discretionary merit bonus, which would be determined by Firm and individual performance.
