The BNSF Railway Law and Claims Department provides expert in-house counsel and collaborates with outside counsel to ensure the railroad operates safely and meets all legal and contractual obligations. Our licensed attorneys and legal professionals are dedicated to upholding the highest legal compliance standards. The specialized Claims team promotes safety, investigates incidents, and resolves them ethically.

This is a full-timeposition located in Houston, TX.

Travel is frequent, yet unpredictable averaging ~30%.

This position is responsible forinvestigating and settling all claims and lawsuits involving the company, arising out of personal injuries or property damage, excluding bill of lading claims.This is a training and educational position designed for later advancement or claim representative position depending on experience.

Key responsibilities may include:

  • Implementing processes and procedures under direction of leadership
  • Cooperating and coordinating with claims personnel on adjacent territories.
  • Performingthorough and ethical investigations to resolveexposures in a fair, honest and responsible manner.
  • Assistingattorneys and paralegals in preparation and trial of lawsuits.
  • Evaluating settlements of claims and lawsuits within proper authority.
  • Workingclosely with all BNSF departments to perform incident investigations/analyses and promote the Claims department's vision statement.
  • Engaging with a variety of external contacts: local counsel, state, county, and city officials, law enforcement personnel, physicians, medical specialists, and expert consulting witnesses in specialized fields.
  • Observingand reviewingpotential liabilities on company property with respective non-claims field personnel.
  • Conducting investigations in various weather conditions.
  • Working irregular hoursand available 24/7 for on-call duties, with frequent evening,night, and weekend shifts (including holidays).

Daily workis conducted in a mixed indoor office and outdoor safety-sensitive environment, where working conditions can include diverse and extreme weather conditions (hot, cold, rain, snow, and sleet), walking and performing work on uneven surfaces, and working around loud noises, fumes, and heavy/moving machinery. Personal protective equipment, a hard hat, safety glasses, and gloves are required and provided by BNSF.

Relocation assistance may be available based on business need.

Basic Qualifications:

  • Able to work in the US without company sponsorship now AND in the future.
  • Bachelor's degree
  • Minimum 1 year experience at BNSF or in a related field (railroad claims, railroad, insurance, legal, investigative) or a combination thereof

Preferred Qualifications

  • General knowledge of railroad operations and principles and/or insurance claims or related medical/legal field
